Dear Customer,

We hereby inform you that Koch's Torma (Hungária) Korlátolt Felelősségű Társaság (hereinafter: Koch's Torma Kft.), as Data Controller, processes personal data of individuals on the basis of a legal authorisation or on the basis of the informed or explicit consent provided by the Data Subject.

I. ABOUT DATA PROCESSING

In the context of data processing activities carried out by Koch's Torma Kft. in relation to its customers, we inform you of the following.

1./ Our Company carries out the following data processing on the basis of legal authorization:

  1. Apprenticeship agreement
    Purpose of the processing: registration of apprentices with an apprenticeship agreement
    Legal basis of the processing: Section 42 - 55 of Act CLXXXVII of 2011 on Vocational Education and Training.
    Processed data: name, mother's name, place and date of birth, ID card number, address, (in the case of a minor student: name, address, telephone number of legal guardian)
    Duration of the processing: 5 years
    Transfer of data: to the relevant county chambers of commerce and industry and to the schools providing theoretical training
  2. Invoicing for sales
    Purpose of the processing: invoicing for sales
    Legal basis of the processing: Section 169 (d) and (e) of Act CXXVII of 2007 on Value Added Tax; Section 169 (1) of Act C of 2000 on Accounting
    Processed data: name, address, tax number
    Duration of the processing: 10 years
  3. Invoicing for the use of procurement, repair and maintenance services
    Purpose of the processing: invoicing for the use of procurement, repair and maintenance services
    Legal basis of the processing: Section 169 (d) and (e) of Act CXXVII of 2007 on Value Added Tax; Section 169 (1) of Act C of 2000 on Accounting
    Processed data: name, address, tax number Duration of the processing: 10 years
  4. Request for data of public interest
    Purpose of the processing: compliance with requests for data of public interest and related invoicing
    Legal basis of the processing: Section 26-31 of Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information
    Processed data: name, address, telephone number, e-mail address
    Duration of the processing: until the intended purpose is accomplished or until the request for deletion is made.
II. ACCESS TO AND TRANSFER OF DATA

We ensure that the personal information provided by you is only accessed by the persons in the relevant job functions, to the extent necessary for the performance of their duties, and subject to a high level of access controls. In addition, the legal adviser or lawyer representing the company will also have access to your personal data in the event that a matter concerning you requires legal proceedings or a legal opinion.

We are legally obliged to disclose the personal data we process in response to requests from public authorities (police, courts, prosecutors, tax authorities, NAIH (National Authority for Data Protection and Freedom of Information)) and national security services. Pursuant to the legislation on archiving and our internal archiving policy, we will transfer the case containing your personal data to the competent Archives after the retention period has expired, unless it can be discarded.

We advise all third parties to which we transfer or disclose your data to comply with the data protection obligations.

III. SECURITY OF DATA PROCESSING

We do not engage the services of any other company to store the personal data provided by you. Appropriate measures will be taken to protect the personal data we hold and to prevent its accidental destruction, unauthorised use or unauthorised alteration.

IV. YOUR RIGHTS AND REMEDIES IN RELATION TO DATA PROCESSING

You may submit requests to the Koch's Torma Kft. Administration Office (by mail: 6100 Kiskunfélegyháza, I. Kerület tanya 241., via e- mail: gdpr@kochs.hu, or info@kochs.hu) with the following subjects:

  1. You are entitled to request information about:
    - the personal data we process,
    - the legal basis for the processing,
    - the purpose of the processing,
    - the source of the data,
    - the duration of the processing,
    - to whom, under which law, to which personal data we have given access or to whom we have transferred your personal data.
  2. You may also request the rectification of your personal data or, except for processing carried out on the basis of a legal authorisation, the deletion of your personal data from the database. Requests for deletion will be refused if we are required by law or by one of our internal rules to continue to store the personal data (for example, if the time limit for the storage of the data set out in our internal rules has not yet expired).
  3. You are entitled to object to the processing of your personal data in case we transfer or use your personal data for direct marketing, public opinion polling or scientific research. You may also object to processing if you consider that such processing is only necessary for compliance with a legal obligation or the exercise of a legitimate interest pursued by us. This right does not, however, apply to processing based on a legal authorisation, for example, you cannot object to the transfer of your request for personal data, together with the case file, to the Archives under our internal rules on document management.
  4. In case your right or legitimate interest is affected by the image recording processed by us, with regard to CCTV recordings on the premises, you may request that the image recording is not destroyed or deleted within 3 days of the recording, by justifying your right or legitimate interest. The request shall be complied with within a maximum of 25 days by letter to the contact details you have provided.

You may lodge a complaint with the National Authority for Data Protection and Freedom of Information (registered office: 1125 Budapest, Szilágyi Erzsébet fasor 22/C. postal address: 1530 Budapest, Pf.: 5., email: ugyfelszolgalat@naih.hu, tel: 06(1)391-1400, website: www.naih.hu). You may initiate a civil action against Koch's Torma Kft. if you experience unlawful data processing.

The present Policy has been drafted in accordance with Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information (" Information Act "), Regulation (EU) 2016/679 of the European Parliament and of the Council and Directive 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of EU law, and we consider ourselves to be subject to its application in the processing of data covered by the Act.
